 Buyeragrees to purchase the Personal Property, in “AS IS”, “WHERE IS” condition withall faults.  Buyer understands that Seller does not expressly orimplicitly warrant that the Personal Property meets or complies with anyapplicable safety and/or regulatory standards (examples: ASTM, ANSI,OSHA).  Buyer is solely responsible for determining that the PersonalProperty is appropriate for any and all particular uses.
 To the fullest extent permitted by law, Buyer shallindemnify, hold harmless and defend the Seller, employees, and volunteers from any and all claims, liabilities,actions, and/or causes of action resulting from injuries, death, damages and/orlosses arising out of, connected with, or in any other way associated with thesale, offer for sale, and/or use of the Personal Property.
  Personaland property risk. Persons attending during exhibition, sale or removal ofgoods assume all risks of damage of or loss to person and property andspecifically release the Seller from liability therefore.
  Inspection.Most items offered for sale are used and may contain defects not immediatelydetectable.  Bidders may inspect the property prior tobidding.  Bidders must adhere to the inspection dates and timesindicated in the item description. . 
  Considerationof Bid. Seller reserves the right to reject any and all bidsand to withdraw from sale any of the Personal Property listed.
  Buyer’s Certificate. Successful bidderswill receive notice by email from e-bay (the “Notice”).
 Payment.Payment in full is due not later than five (5) business days from the time anddate of the Notice.  
 
 
Removal. All items must be removed within ten(10) business days from the time and date of issuance of theNotice.  Purchases will be released only upon receipt of payment asspecified above.  Successful bidders are responsible for loading andremoval of any and all property awarded to them from the place where theproperty is located as indicated on the website.  The Buyer will makeall arrangements and perform all work necessary, including packing, loading andtransportation of the property.  Under no circumstances will theSeller assume responsibility for packing, loading orshipping.  Property may be removed between the hours of 9:00 a.m. and3:00 p.m., Monday through Friday, excluding legal holidays by prior appointmentonly.   
 Vehiclesof Titles. Sellerwill issue title or certificate upon receipt of payment.  Titlesmay be subject to any restrictions as indicated in the item description on thewebsite.  Open titles cannot be issued.  The Seller will not issue replacement titles.
 
 Default. Default by Buyer shall include (1)failure by Buyer to observe these terms and conditions; (2) failure to makegood and timely payment; or (3) failure to remove all items within thespecified time.  If the Buyer fails in the performance of anyobligation hereunder, as provided herein, Seller may terminate this Agreementand shall be entitled to all rights and remedies as are provided by law and/orequity, including attorney’s fees and court costs.  Seller reserves theright to reclaim and resell all items not removed by Buyer upon the expirationof the specified removal date.
  State/Local Sales and/or Use Tax. Buyers may be subject to payment of Stateand/or local sales and/or use tax if registered in Florida.
